suit against Traffic Power for violations of the Telephone Consumer
Protection Act of 1991, for calling my cellular phone with their add.
Specifically, I want to hear how any calls you received were handled.
Di that send you a do-not-call policy when requested, did they know
the difference between 'taking your name off the list' and adding it
to a specific DNC list? When they called, did the call provide a full
name as well as the phone number or mailing address, without your
having to ask, or even at all? I will be filing in a couple of days,
and depending on how they answer, may see if anyone is willing to send
an affidavit concerning their experiences. I am suing for $5000 based
on the single call due to multiple violations of the law (47 usc 227).
Email me if you have info to share and I'll update you with my case.
What may be of most importance is a copy of a canceled check. If I win
a default judgment, it may be hard to collect, but if I have their
bank account information, I can simply have the local sheriff go to
their bank and withdraw the funds to cover the judgment. If only a
credit card was used, then please let me know of the Id information
printed on the statement (or a scan of the statement if possible).
